Useful information for environmental associations seeking recognition according to the Environmental Appeals Act (UmwRG)
The Environmental Appeals Act grants associations special rights to ensure compliance with environmental or nature conservation law.
Associations seeking to obtain recognition as an environmental association must meet certain requirements.
Environmental and nature conservation associations can gain recognition pursuant to art. 3 Environmental Appeals Act (Umwelt-Rechtsbehelfsgesetz, UmwRG) and thereby acquire special participation and litigation rights. The German Environment Agency (UBA) and the competent authorities at federal state (Länder) level are responsible for granting recognition.
In accordance with the German Constitution (Basic Law – Grundgesetz, GG) anyone asserting that their rights are being infringed by public authority may have recourse to the courts (Section 42 (2) Code of Administrative Court Procedure – Verwaltungsgerichtsordnung, VwGO).
